1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the CallRescue website and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

2. Service Description

CallRescue provides a Daily Motivational SMS program that delivers one inspirational text message per day to subscribers’ mobile devices (“Daily Motivational SMS”).

3. Eligibility

You must be the owner or authorized user of the mobile number you provide and be of legal age to consent to receive text messages in your jurisdiction.

4. User Responsibilities

You agree to: (a) provide accurate information; (b) only subscribe with a mobile number you own or control; (c) comply with these Terms and all applicable laws.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

To the maximum extent permitted by law, CallRescue and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.

8. Indemnification

You agree to indemnify and hold harmless CallRescue, its affiliates, officers, agents, and employees from any claim, demand, loss, or damages, including reasonable attorneys’ fees, arising out of or related to your misuse of the Service or violation of these Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. You agree to submit to the personal jurisdiction of the state and federal courts located in California for any dispute arising out of these Terms.

10. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Changes will be effective when posted. Your continued use of the Service following the posting of changes constitutes acceptance of those changes.
